We received our 1099 from our broker TD Ameritrade but the
merger is not included on the form for 2009. I also notice
that they have not included it in our Dec statement. They
have it as 1/4/10.

Everything that I have read says that the acquisition took place on 12/31/09, using the closing prices as of 12/30/09. I suggest that you ask your broker when you should be reporting any income from the transaction, as they may have more information.
