I mailed Club return Certified with returned receipt by noon on Mar 15. Received $2,500 penalty and form in Sept. Called IRS, Agent said she could not look up tracking, refused to check date stamp on envelope. I had to send tracking report and form. After 4 calls and 3 certified mailings and interest added, an agent just looked up tracking, took 5 minutes to remove penalty and sent club a removal letter using a form letter that said first late filing is forgiven, next paragraph said 1065 was not late and penalty removed.
I printed 7004 instructions say hours to complete but only only took 5 min. Mailing certified also.
@Alessandro - Was it simply due to covid or was it due to some other unforeseen circumstances, you had to file late? Hence, resulted in having to be penalized by the IRS? This is our first year and I am really concerned.
In looking back I see that some clubs have filed a CPAR?? Please tell us what that is and whether our small club of 10 members missed something? Thank you.
It's not that bivio doesn't plan to get you your tax information before March 15, it's that bivio doesn't know if it can. There are massive late changes to the forms for this year, and the programmers are laboring to get the changes implemented. It may not provide any comfort, but the IRS won't guarantee that they can process partnership returns with Schedules K-2 and K-3 until March 20 which is after the regular due date. This is a situation, like COVID was in 2020, that is beyond anyone's control.

The same happened to us 3 years in a row. We filled by March 10. IRS threatened to take action if we did not pay. It is crazy, For this reason we're disbanding our partnership...

If you filed by March 10 each year and sent your forms Certified mail return receipt requested and still were penalized, there is something more to this story.
It doesn't make sense as you've stated it.

Yes, I sent three letters, different months with a form, request for abatement. With proof, USPS Certified Receipt, that we filled by March 10th. The return receipt shows that they received it by March 30th.
The previous year we did file 5 days late, due to Covid. But, dealing with the IRS is a nightmare... Maybe they are overworked for their complexity and stupidity, And, everytime I called them via phone, if you get through, you're lucky, then they want you to fax them the 1065 and K1s as proof. I'm done!

The same thing happened to our club last year. They said we filed late. We had the certified mail receipt, dated right on March 15th. They didn't mark the forms received until March 30th.
I tried to talk to someone at the IRS and was on hold for HOURS. Finally a member working from home waited it out and was able to reach a helpful person at the IRS, and after sending the certified receipt along with a certified letter,
the fee was removed and the situation was resolved.
Doesn't seem like they have a very good system in place...
But this year filing for the club looks like it is going to be a nightmare!
I wonder what lawyers and tax preparers are doing for their clients?

Congress has cut IRS funding repeatedly for decades. And passed budgets late so multiplayer continuing resolutions each year for decades so IRS can't hire phone staff.
The IRS has real people who will help you, but the phone delays are hours.
Contact your senators and representatives to encouage them to pass budgets on time, and fund the IRS for CSRs. Cutting taxes is a political no brainer promise, but we are all living the impact. (I dislike paying taxes just like all of you, but would appreciate Congress funding the IRS for CSRs for phones).
Best, Irina
